    Well, we got that finance and that new house, which is a multi generation dwelling so we can care for our oldies.

    Coronavirus has meant original home has to come off the market, and oldies are stuck down south due to the travel restrictions.

    So yeah - hasn’t worked out as we planned LOL
    And we haven’t managed to acquire anything in the Snowys! :cry:

    I thought it’s in Woodbridge 2 right near the bridge, he put a post about someone breaking into the unit up as well which looked like one of the units I like


    I wouldn’t be to confident, I have had my biggest month of approvals in years! The last two weeks have been hectic!

    I am 99% sure I know who he is, and if it is who I think he i don’t hold much respect for him.

    the 28 week thing is a furfy do Nat parks really care, not letting the property out is helping the environment in a round about way. And sure I can advertise my place at $25k for a week in winter, oh well no takers I’ll stay there myself.

    I suspect that the leases are the same, but if you want your property to be managed by the accommodation centre (and probably others) it has to be available for lease for a minimum of weeks over the season/year. Just guessing, but it makes commercial sense.

    I'm a bit confused here and have been for a while. I was under the impression that all Thredbo property was under the same lease system which basically meant it was for holiday accommodation only and a lease condition was that it was available for rent to others periodically (some carveouts for those required to live there to keep the place running).

    But this usually jarred with my observations of some places not really looking like they were set up for holiday rental all. Examples are personal effects clutter on the balconies. Places up for sale on the web looking well lived in. And those townhouses opposite the tennis courts.

    I did wonder whether enforcement of lease conditions was happening at all.

    AirBNB counts too I suppose? Just make the letting fee be well above market rate, oh well you made it available for lease during 6 months of the year. It isn't your fault no one stayed there.

    The leases are all the same, some people who work there or have business there I assume can apply for an exception to the rules.

    But there are lots who happily don’t let there place out. Kt don’t care as they are still making money and not having everything let, eases the pressure on car spaces and services.

    I doubt national parks care either, enforcing this lease clause in any way would be costly.

    I think the gentleman who started the Facebook rant is the only one who cares as he operates a holiday let business.

    KT have sent some letters out this week asking owners to state that their place is available for rent six months or the year. Maybe they will start enforcing the leases?

    being available for rent is pretty key there. An owner can make their place available for rent at an inflated price and decide to still live in it as there are no bookings. Is that doable?

    Nah not really. The clause is ‘reasonably available’ or some such. It wasn’t drafted by idiots.

    In sun peaks, area are zoned for residential and for short term rental, but nothing was enforced and residential places were being rented out. Then the council stepped in and enforced the rental restrictions with fines of (?) $10m000 per night. All of a suddent therer ws a rush of properties put on the makret by people who had clearly felt it was on to ignore the rules because they were never enforced

    do the other mountains that have villages like thredbo follow the same requirement for needing lease the property out for selected periods?

    I would be interested in seeing how a court would treat such a clause if someone took an action under the Competition and Consumer Act.

    If you owned a place, make it place avaiable to rent right at the top end of pricing, and then place an advert in the local community newspaper, also specifying all the faults wit the place

    However, if you flip it around, if its a government enforced policy - are they not exempt for competition law?

    What makes you think it is government enforced? The sub-leases are between Kosciusko Thredbo P/L and the sub-lessees. Although the CC Act applies to government enterprises with a commercial flavour.

    I'm not aware of where the requirement commenced, but it might be a rquirement of the National Park?

    Could also be the KT are simply fulfilling a legal obligation I.e remind everyone that they are supposed to lease the unit and then turn a blind eye again.

    KT seriously struggle to check units between stays for damage as they are that stretched in winter and parks are no better. So who would enforce?

    KT have the lease for Thredbo so everything is Sub-let. The rules have been the rules since day dot and will be the rules for the next 40 something years.

    Still doesn’t change commercial reality.

    lots of people will never rent out their apartments. KT and NPWS don’t have the man power to enforce and even if they did would they really want to? These people spend lots in the village, kids are all in programs, they hire instructors and still eat out. I seriously doubt it.

    No, it's outside the NP and is a freehold development. Pretty sure the terms don't limit stays.

    My point is that a provision restricting trade may fall foul of the Competition & Consumer Act. Or it may not. If it is enforced there are people with properties in Thredbo with pockets deep enough to try it on.

    not per se breach these days. where's the lessening of competition though? is there a suggestion that agents have been denied accreditation by KT?
    i also dont see an incentive for apartment owners to reach into their deep pockets to test it. a couple of % commission in it for them, at most and no guarantees of any savings.
