    No, but what Perisher can do is throw you off their slopes and ban you from going back.

    How? Do they have special powers of removal? Can they recognise if a mate buys me a day pass if banned (not that I'd ever spend money there).

    What's interesting is that Perisher's land boundaries are contained to Lifts/Tows and buildings. This is the boundaries map which can be accessed via Six Maps. Maybe the runs are leased via a different mechanism through NPWS, I have no idea? Regardless of the legal status I'd be exercising caution and common sense if you choose to skin up.

    So they have no jurisdiction over the actual ski runs only the infrastructure footprint. Its a public asset, they lease bits of it. They can't physically remove you, that would be assault.

    There is something called the franchise area, which covers the whole resort. I don't know what rights it gives them but would be surprised if they didn't have the power to manage the area, including removing people.

    but un-qualified thoughts from out my arse....
    I suspect it simply comes along the lines of Duty of Care by " The Resort " operators.
    considering the machinery ( plant & equipment) they are operating in providing a service ( i'e the resort , groomed trails and lifting ) to the public whether they are a paying customer or some-one who has just hiked in from the carpark or main range.
    the applicable Law of nature would be " shit happens ".
    and if the punters aren't stumbling around where you would not reasonably expect them then that reduces the risk.
    If you are shown to be pro-active in providing " rules" or a firm Policy then you are more likely to be viewed less than negligent when inevitably shit happens.

    Isn’t it something like- the lease is for the asset areas, but the ski area has some kind of area of operations definition and restrictions?

    Yes actually they can.

    They no require all cardholders to have an acct that they link the pass too. You actually have to show I'd to pic up your day pass.

    Also the cc that you used to pay for it.

    Stood and watched a guy skin up the RHS of Front Valley at Perisher only 2 days ago. Nobody seemed to take an interest other than me as as was trying to figure out where I could practice uphill walking in safety and out of everyone's way with the new gear I just purchased. I didn't feel like driving all the way round to Guthega just to test out my gear.
    I suppose if there was more snow, I could have practised by skinning up the road toward Eyre / Charlottes Pass???

    Skinning up groomer is lots different to skinning unconsolidated snow and negotiating wind drifts and sastrugi.

    The only areas where Perisher has the right to restrict your movement in your National Park is within their Physical Assets. Their lease does not give Perisher the power to prevent people entering those leases. The franchise area, as described in the Alpine Resorts SEPP is the area in which Perisher may conduct "Ski Resort Operations".



    If you decide to skin uphill against the policy Perisher Staff can't stop you, however what they can do is call a Ranger, or Policeman who do have the power to remove you.

    Why choose to skin uphill at the resort? Aren’t there other hills nearby? I thought the whole “backcountry” aspect of this forum was about being away from the resorts! Yeah, yeah, I know, it was just a discussion, and I chuck my post in tongue in cheek.

    I agree!

    Which is why you don't want the resort to ban you altogether!

    But skinning after dark has its appeal.

    And perisher (as the area not the resort) doesn't have much watching so not as high risk.

    I can think of a few reasons.
    Practising in a controlled environment.
    Someone who doesn't want to pay the lift pass, but wants the safety of a resort.
    Someone who has paid for their lift pass, but chooses to skin regardless for environmental reasons.

    In Europe skinning up in the resort makes sense to avoid being or causing a avy hazard.

    Also there will be a decent cafe at the top.

    And the format of the races involves skinning up groomed routes. Did I mention how massive this race scene is in Europe.

    A bit of resort skinning used to be a good way to get to paralysed havevis the odd tow line. Then RFID gates came along.

    They tried to get a head lease arrangement, similar to Thredbo, and it was rejected in 2017

    If the accessible snow level starts at the resort, and they close the snowless road past the resort. How the Fark can you get to the BC without going through the Resort ???

    A group familiar with Perisher and surroundings, and wanting a little Side Country, without getting lost and dead.

    A group wanting to just try Cross Country skis in familiar terrain.

    For the number of uphill skiers. Forcing nubes to into unfamiliar areas, is not intelligent.

    If u need to go through resort just get your arse out of bed a bit earlier and make sure you’re out of resort before lifts start up. Don’t know how many times I’ve ran in to Mountain operators, groomers and ski patrollers over the years and always just giving you a wave asking where you off to.
    I could be wrong but unless you do something stupid I don’t think anyone’s gonna care.

    Saw an obviously nube group of 5 cross country skiers, practicing going up about 20m at the bottom of Centre Valley yesterday. Then making some turns down. It was deserted and nobody worried about them.

    Seems a shame that Mountain Ops were supposed to chuck them out.

    The people familiar with Perisher would, apparently, not be you. If you want the Paralyser get to Perisher Gap and go from there. And then there is all the other side country like ... ummm ... and ummm. If you want cross country cross the road.

    Except the trails across the road are not yet open.

    Early and late in the season and on mad race days XC folks often use the area / zone between the road and lifts.

    And if they do not have a lift pass that is what most folks do. I've not yet met folks skinning thru the resort to get to Paralyser, but I'll keep an eye out to look for them now.
